These Terms & Conditions (“Terms”) govern your access to and use of zarbaaz.com and any related sites or pages that link to these Terms (the “Site”), as well as your purchase and use of any products sold under the Zarbaaz brand (the “Products”).

The Site is operated by Zarbaaz LLC, a Maryland limited liability company (“Zarbaaz LLC,” “we,” “us,” or “our”).

By accessing the Site, browsing, or purchasing Products, you agree to be bound by these Terms, along with any other policies referenced here (including our Shipping & Returns Policy and Privacy Policy). If you do not agree, do not use the Site or purchase Products.

1. LEGAL ENTITY, SCOPE & GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Maryland, USA, without regard to conflict-of-law principles.

Any dispute arising out of or relating to the Site, the Products, or these Terms shall be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.

2. ACCEPTANCE OF TERMS & CHANGES

2.1 By using the Site or purchasing Products, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2.2 We may update these Terms at any time by posting the revised version on the Site with a new “Last Updated” date. Your continued use of the Site or purchase of Products after changes are posted constitutes your acceptance of the revised Terms.

3. ELIGIBILITY

3.1 You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase Products from the Site.

3.2 By using the Site, you represent and warrant that:

  • You have the legal capacity to enter into a binding contract; and

  • You will comply with these Terms and all applicable laws.

4. USE OF THE SITE & PROHIBITED CONDUCT

4.1 You may use the Site only for lawful purposes and in accordance with these Terms.

4.2 You agree not to:

  • Use the Site in violation of any applicable law, regulation, or rule;

5. ORDERS, PRICING, PAYMENTS & PROMOTIONS

5.1 Order as Offer.

All information on the Site is an invitation to treat, not a binding offer. Your order is an offer to purchase Products from us under these Terms. We are not obligated to accept any order.

5.2 Order Acceptance & Cancellation by Us.

We may accept or reject any order at our sole discretion. Reasons we may refuse or cancel an order include (without limitation):

  • Product unavailability or limited stock;

  • Pricing errors or other obvious mistakes;

  • Inability to authorize payment;

  • Suspected fraud or misuse;

  • Orders that appear to be placed by resellers, distributors, or bulk purchasers;

  • Shipping or regulatory restrictions.

If we cancel an order after payment is received, we will issue a refund for the cancelled items.

5.3 Pricing & Taxes.

  • Prices are listed in U.S. dollars (USD).

  • Prices and promotions may change at any time without notice.

  • Applicable sales tax and other required taxes will be added at checkout based on your shipping address.

  • We reserve the right to correct any errors in pricing or product information and to cancel or adjust orders impacted by such errors.

5.4 Payment Methods.
We accept the payment methods listed at checkout (e.g., major credit/debit cards, digital wallets). By providing payment information, you represent that:

  • You are authorized to use the selected payment method; and

  • The information is accurate and complete.

Payment is typically charged at checkout. If payment cannot be processed, we may cancel or hold your order.

5.5 Discounts, Promo Codes & Offers.

  • Promotional codes, discounts, bundles, or other offers are subject to specific terms, expiration dates, and availability.

  • We may limit or deny promotions for any reason, including suspected abuse.

  • Unless explicitly allowed, promotions cannot be combined.

  • We may modify or terminate any promotion at any time.

6. SHIPPING, DELIVERY & RISK OF LOSS

6.1 Shipping Regions & Methods.
We ship to the regions listed on the Site’s checkout page. Certain Products may be restricted due to flammable contents (alcohol) or carrier regulations.

6.2 Flammable Product Notice.
Many Zarbaaz fragrances contain alcohol and may be classified as flammable liquids. As a result:

  • Certain shipping methods (e.g., ground-only) may be required;

  • Some destinations may not be eligible;

  • Delivery times may vary based on carrier and regulatory restrictions.

6.3 Delivery Estimates.
Any delivery dates or time frames are estimates only, not guarantees. We are not liable for delays caused by:

  • Carriers;

  • Customs (if applicable);

  • Weather or natural events;

  • High-volume periods;

  • Other events beyond our reasonable control.

6.4 Risk of Loss & Title.
Title and risk of loss for Products pass to you once the package is scanned as accepted or picked up by the carrier.

After carrier acceptance, we are not responsible for:

  • Loss, theft, or damage occurring after delivery is marked complete; or

  • Packages delivered to addresses you provided incorrectly.

If you believe a package is lost or stolen after a carrier marks it delivered, you agree to:

  • Check with neighbors/building management;

  • Contact the carrier; and

  • Then contact us with relevant details so we can determine, at our discretion, any possible support or replacement.

7. RETURNS, EXCHANGES & REFUNDS

Because fragrances are cosmetic and hygiene-sensitive:

7.1 Opened Products – Final Sale.
Products that have been opened, sprayed, unsealed, or used are generally not eligible for return or refund, except where required by law.

7.2 Unopened Products.
We may accept returns of unopened, unused Products in their original condition and packaging within [14 or 30] days of delivery, subject to:

  • You contacting us first at info@zarbaaz.com for authorization;

  • You covering return shipping unless the return is due to our error;

  • Our inspection and approval of returned items.

7.3 Incorrect, Defective or Damaged Products.
If you receive:

  • The wrong item,

  • A clearly defective item, or

  • Products clearly damaged in transit,

You must contact us within [7] days of delivery with:

  • Your order number;

  • Photos of the packaging and affected Products;

  • A description of the issue.

At our discretion, we may:

  • Replace the item;

  • Offer store credit; or

  • Provide a refund to your original payment method.

7.4 Scent Preference & Skin Reaction.

We do not guarantee that you will personally like any fragrance or that it will perform the same on your skin as on others. Personal scent preference, longevity differences, or normal variations in perception are not valid grounds for returns, except where required by applicable law.

7.5 Return Policy Incorporation.
Our detailed Shipping & Returns Policy (as posted on the Site) is incorporated into these Terms. In the event of a conflict, that policy governs returns and logistics.

8. PRODUCT INFORMATION, SAFETY & DISCLAIMERS

8.1 Cosmetic Use Only.
Zarbaaz Products are cosmetic fragrance products intended for external use only.Do not ingest. Do not apply to broken, irritated, or infected skin. Avoid spraying into eyes, nose, or mouth.

8.2 Allergies & Sensitivities.
Fragrances and cosmetic ingredients can cause allergies or irritation in some individuals. By purchasing or using our Products, you acknowledge and agree that:

  • You are responsible for reviewing the ingredient list provided on the packaging or Site;

  • You may perform a patch test before full use;

  • We are not liable for allergic reactions, sensitivities, or irritation, except where required by law.

If irritation occurs, stop using the Product and consult a medical professional if necessary.

8.3 Ingredient Lists & Variations.
While we strive for accuracy, ingredient lists, notes, and descriptions may occasionally change due to formulation updates, regulatory changes, or supply. The ingredient list on the physical product packaging is the most current and controlling version.

8.4 No Medical Claims.
Our Products and content:

  • Are not intended to diagnose, treat, cure, or prevent any disease;

  • Are not medical or therapeutic products;

  • Should not be interpreted as medical advice.

8.5 Color, Scent & Packaging Variations.
Due to manufacturing and batch variations:

  • Color, intensity, or packaging details may differ slightly from photos;

  • Scent perception may vary from batch to batch within normal cosmetic tolerances.

These variations do not constitute defects.

9. INTELLECTUAL PROPERTY

9.1 Ownership.
All content on the Site— including text, logos, graphics, images, product designs, packaging, icons, videos, sounds, and software (collectively, “Content”)—is owned by or licensed to Zarbaaz LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

9.2 Trademarks.
“Zarbaaz,” related logos, trade dress, bottle designs, and branding are trademarks and/or trade dress of Zarbaaz LLC. You may not use them without our prior written permission.

9.3 Limited License for Personal Use.
We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only. You may not:

  • Copy, reproduce, republish, distribute, or modify any Content for commercial use;

  • Remove or alter any copyright, trademark, or proprietary notices;

  • Reverse engineer or attempt to extract source code from the Site or its software.

Any rights not expressly granted are reserved by Zarbaaz LLC.

10. USER CONTENT, REVIEWS & FEEDBACK

10.1 User Content.
When you submit reviews, comments, photos, suggestions, or any other content (“User Content”) through the Site or our social channels, you represent and warrant that:

  • The content is truthful and reflects your genuine experience;

  • You own or control all necessary rights to that content;

  • It does not infringe any third-party intellectual property, privacy, or other rights;

  • It does not contain unlawful, defamatory, abusive, obscene, or hateful material;

  • It does not contain viruses, malware, or harmful code.

10.2 License to Use User Content.
By submitting User Content, you grant us a perpetual, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such content in any media, for any lawful business purpose, including marketing and advertising.

10.3 Moderation.
We may, but are not obligated to, monitor, edit, or remove User Content at our sole discretion.

11. THIRD-PARTY LINKS, TOOLS & SERVICES

11.1 The Site may contain links to third-party websites, services, or tools. These are provided for convenience only. We do not control, endorse, or assume responsibility for:

  • The content, policies, or practices of any third-party site;

  • Any products, services, or materials available there.

11.2 Your use of third-party sites and tools is at your own risk and subject to the terms and policies of those third parties.

12. NO CUSTOMER ACCOUNTS (CURRENTLY)

At this time, we do not require or offer customer accounts for purchases. Orders are processed as guest checkouts.

If we introduce accounts in the future, additional or revised terms may apply to account creation and use.

13. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ITS CONTENT, AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY;

  • FITNESS FOR A PARTICULAR PURPOSE;

  • NON-INFRINGEMENT;

  • TITLE;

  • OR ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT:

  • THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;

  • DEFECTS WILL BE CORRECTED;

  • THE SITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;

  • ANY PRODUCT WILL MEET YOUR PERSONAL PREFERENCES OR EXPECTATIONS.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

14.1 NO INDIRECT DAMAGES.

Zarbaaz LLC, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS;

  • LOSS OF REVENUE;

  • LOSS OF DATA;

  • LOSS OF GOODWILL;

  • BUSINESS INTERRUPTION;
    ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SITE

OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.2 CAP ON DIRECT DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF CERTAIN DAMAGES; IN SUCH CASES, THESE LIMITATIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Zarbaaz LLC, its owners, directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or Products;

  • Your breach of these Terms;

  • Your violation of any law or third-party rights;

  • Any User Content you submit.

16. CHANGES TO THE SITE & SERVICE

We may, at any time and without notice:

  • Modify, suspend, or discontinue any part of the Site or Services;

  • Change Product offerings, pricing, or availability.

We are not liable to you or any third party for such modifications, suspensions, or discontinuations.

17. SEVERABILITY, WAIVER & ENTIRE AGREEMENT

17.1 Severability.
If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.

17.2 No Waiver.
Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.

17.3 Entire Agreement.
These Terms, together with any policies referenced or linked on the Site (including our Privacy Policy and Shipping & Returns Policy), constitute the entire agreement between you and Zarbaaz LLC with respect to the Site and Products, and supersede all prior or contemporaneous agreements, communications, and proposals, whether written or oral.
